Who is required to have a Mortgage Loan Originator license in Rhode Island?
Any natural person who is an employee (or provisional employee) of a licensed lender or loan broker must hold this license if they receive or expect a fee, commission, or other consideration for advising applicants on loan products and terms, assisting with loan applications, or negotiating a mortgage loan.
Who is exempt from needing a Mortgage Loan Originator license in Rhode Island?
Exemptions apply to MLOs employed by an operating subsidiary of a financial or banking institution organized under state or US laws (provided an applicable educational program is offered), individual loan officers who do not originate loans secured by real property, and individuals whose roles are strictly ministerial and clerical.
What are the financial and background pre-requisites for a Rhode Island MLO license?
Applicants must demonstrate a positive net worth, clear a mandatory criminal background check, satisfy official testing requirements, and complete all required pre-licensure education. Individual surety bonds are not required for individual MLOs.
How many hours of pre-licensure education (PE) are required for Rhode Island?
Applicants must complete our 20-hour NMLS-approved pre-licensure education course. Afte the 20-hour course, studnets will complete 3-hours of Rhode Island state-specific law content.
What are the testing requirements to satisfy a Rhode Island MLO license?
Applicants must achieve a passing score on the National Test Component with Uniform State Content (SAFE MLO EXAM). Your NMLS filing must explicitly show this component is satisfied.
How can I check my application status or see messages from the state regulator?
The Rhode Island Department of Business Regulation communicates directly through the NMLS portal. To view your active status or review detailed communication notes, navigate to the "Composite View" tab and select "View License/Registration" within NMLS.
What happens if I apply for a license before finding employment with a mortgage company?
If you are not currently sponsored by a mortgage company, your license will be issued in an "Approved-Inactive" status. Once you find a sponsor, they will activate your license for you in NMLS.
Do I still need to take continuing education if my Rhode Island license is inactive?
Yes. Even while your license is held in an "Approved-Inactive" status, you must continue to comply with all active licensee requirements, which explicitly includes meeting all ongoing continuing education requirements.
What are the employment and tax classification rules for Rhode Island MLOs?
Rhode Island licensed MLOs must be exclusive W-2 employees of their sponsoring broker or lender. State guidelines strictly prohibit MLOs from operating or being compensated as 1099 contract employees.
Can a Rhode Island licensed MLO work for multiple mortgage companies at the same time?
No. Rhode Island licensed MLOs are restricted to working as exclusive employees for only one Rhode Island licensed mortgage broker or mortgage lender at a time. Working for more than one licensee simultaneously is prohibited.
What are the state application and registration fees for a Rhode Island MLO?
The state application fee is $200.00, the license registration fee is $400.00.
What are the internal NMLS processing fees for Rhode Island?
Separate from state-level registration costs, the NMLS system requires a standard NMLS Processing Fee of $35.00 and an NMLS Sponsorship Fee of $35.00.
Are background checks and credit reports mandatory for Rhode Island MLO applicants?
Yes, both an NMLS credit report and an NMLS criminal background check (CBC) are mandatory items. After authorizing your CBC via the MU4 form, you must schedule a fingerprinting appointment unless you qualify to "Use Existing Prints" already stored on file.
Is remote work permitted for licensed MLOs under Rhode Island law?
Yes, working remotely is fully allowed. However, your sponsoring employer is legally required to upload their comprehensive corporate Remote Work Policy directly into the system.
